This Privacy and Cookie Policy describes the practices of FRIMESA COOPERATIVA CENTRAL, with headquarters at Rua Bahia, nº 159, in the city and county of Medianeira, state of Paraná, registered under CNPJ/MF no. 77.595.395/0001-47, in relation to personal data collected by FRIMESA in its various cooperative and corporate activities, as well as describes the use of cookies on the websites www.frimesa.com.br, acarnequeomundoprefere.com.br and friminho.com.br.

The Data subject is the individual to whom the personal data object of the processing refer. The objective of the LGPD is to establish guidelines to collect and process personal data, safeguarding the rights of the data subjects, as the personal data belongs exclusively to the data subject.

Personal data is all information related to an identified or identifiable individual. Identified should be understood as information that can be directly linked to a data subject. On the other hand, identifiable means information that, when gathered, has the ability to identify a data subject.

Personal data processing is any action taken directly in processing personal data, from collecting, sharing, use, processing, file, ending the processing with the deletion or anonymization of personal data.

>  WHO IS THE DATA CONTROLLER?

The data controller is one of the processing agents, who remains in charge of the decision-making power over personal data. According to the LGPD, "individual or legal entity, of public or private law, who is responsible for decisions regarding personal data processing". If you are hired, your personal data will be processed to enter into the employment contract and also to comply with legal obligations.

Remembering that, if you are a minor, your personal data will only be processed with the consent of a parent or their legal representative, so that you can be hired in our internship and young apprentice programs.

If you are a consumer of FRIMESA products, your personal data will be processed so that FRIMESA can serve you and provide information or ask questions about your products. If you have questions about our products, talk to our Customer Service.

If you are a rural producer associated with our affiliated cooperatives, LAR, COPACOL, C. VALE, PRIMATO and COPAGRIL, your personal data is used to ensure the traceability of our products. Our essence lies in ensuring the best gets to your table.

If you are the legal representative or attorney of a customer, supplier, commercial representative or partner, your personal data will be processed for procedures related to contract execution and compliance with legal obligations.

Careers: communication channel reserved for people interested in working at FRIMESA, so that the Candidate Portal can (i) check available job vacancies and (ii) register your resume. If you are a minor, you must request authorization from your parents to register your resume in the Internship Program and in the Young Apprentice Program.

Our communication channels are aimed at adults and are not intended for children and adolescents. Personal data of adolescents will only be received and processed with specific consent from their parents or legal guardians, to attend the INTERNSHIP PROGRAM and YOUNG APPRENTICE.

5. SHARING PERSONAL DATA

Subject to the criteria defined in this Policy, FRIMESA will not disclose the personal data collected, except to meet the necessary measures within the terms of the applicable laws, rules or regulations; in the event of an obligation to disclose; or at the request of the data subject, upon his/her consent.

6. DATA STORAGE AND RECORDING

Personal data will be stored for as long as necessary to maintain communication with the USER as necessary for the purposes described in this Privacy and Cookie Policy. Where there is no longer a legitimate business need in progress to process your personal data, FRIMESA will delete or ensure the anonymity of your personal data.

Personal data will only be stored for as long as necessary to comply with the purposes for which it was collected, unless there is any other reason to maintain it, such as, for example, compliance with any legal, regulatory, contractual obligations, among others, provided that they are based on a Legal Basis.

To better manage the retention and deletion of personal data, FRIMESA has established clear rules for monitoring and auditing, established in its Personal Data Retention Policy and Time Table.

Personal data may be deleted at any time, if requested by the USER.

FRIMESA has an Information Security Policy so that its personal data processing activities are protected, ensuring the privacy and protection of personal data. Data storage will be carried out in a safe and controlled environment.

7. INTERNATIONAL TRANSFER OF PERSONAL DATA

Currently, FRIMESA transfers personal data outside Brazil, and data subjects are assured of all necessary security measures, as well as the execution of agreements with contractual clauses of confidentiality and secrecy. The other specific provisions of the Brazilian law on personal data protection that provide an adequate degree of protection of personal data are duly respected by FRIMESA in the international transfer of USER data.

8. DISPLAY, RECTIFICATION AND DELETION OF DATA

Using the same service tool, the USER can: (i) request the limitation of use of their personal data; (ii) express their opposition to the use of their personal data, or (iii) request the deletion of their personal data collected and recorded by FRIMESA.

The USER is also guaranteed the exercise of all rights contained in article 18 of Law 13.709/18, mainly the following:

I - confirmation of the existence of processing;

II - access to data;

III - correction of incomplete, inaccurate or outdated data;

IV - anonymization, blocking or elimination of unnecessary, excessive or processed data in violation of the provisions of the Law;

V - portability of data to another service or product provider, upon explicit request, in accordance with the regulations of the national authority, observing commercial and industrial secrets;

VI - elimination of personal data processed with consent from the data subject, except in the cases provided for in art. 16, of Law 13.709/18;

VII - information on the shared use of data.

The USER is also guaranteed the right to file a complaint with ANPD – Autoridade Nacional de Proteção de Dados [National Data Protection Authority].

9. DATA SECURITY AND PRIVACY

FRIMESA implements reasonable protective measures against physical, administrative and technical threats to protect your personal information from unauthorized access, use and disclosure.

10. OUR RESPONSIBILITY

FRIMESA takes care of your personal data, because by taking care of your personal data we are protecting you from unwanted situations that may harm you. We have created internal policies and procedures to better manage our privacy governance. We rely on the training and awareness of our team. We invest in technical information security measures. We evaluate our suppliers and insert contractual clauses and conditions to ensure personal data protection. However, total security depends on more than just our actions and processes. Entry or unauthorized use of your account by third parties, failure of hardware or software that is not under FRIMESA´s controland other factors may compromise the security of your Personal Data. Therefore, your involvement is fundamental to maintain an environment that is safe for everyone.

It is important that you also adopt security measures in your daily life, creating strong passwords, not sharing your password, using licensed software, having antivirus, as well as having good practices with regard to information security.

11.  GENERAL PROVISIONS

This Privacy and Cookie Policy and the relationship arising from the actions comprised herein, as well as any dispute that arises as a result thereof will be governed exclusively by Brazilian law.

 

The Central Forum of the District of Medianeira, state of Paraná, is hereby elected to settle any matter involving this document, the parties renouncing any other, however preferable it may be or become.
